MDP Program Terms and Conditions
- The customer certifies that all information provided on the application form is correct and that the customer will notify the TTC immediately, in writing, in the event of any changes to the information. The TTC’s address is 1900 Yonge Street, Toronto, Ontario, M4S 1Z2. Attention: Metropass Discount Plan.
- The customer hereby authorizes the TTC, its agents or designated financial institution(s), to obtain monthly fees, installments thereof and any other charges authorized by this agreement from the customer’s bank/trust company as indicated on the application, on dates and times as may be specified by the TTC. The TTC must be notified of any changes in the customer’s authorized account.
- The customer certifies and agrees that the account referred to in the application form is in good standing and with sufficient funds to cover the cost of pre-authorized payments and any other charges as they become due.
- It is understood that there is a $25.00 service charge for any transaction not honoured. The TTC reserves the right to change the amount of the service charge from time to time.
- In the event of default, the customer agrees to pay, over and above the liabilities hereunder, all costs of collection. If there is a default in the payment of any fees or installments of fees as and when due or default or other breach of the terms hereof then the TTC may, on notice to the customer, terminate this agreement.
- The customer’s address for service shall be as set out on the application or at such other address as the customer may from time to time advise the TTC in writing.
- The TTC shall have the right to reject any application at its own discretion and to terminate this agreement at any time upon notice to the customer.
- This agreement is for a 12-month period and will automatically renew on an annual basis thereafter. The TTC guarantees, subject to the provisions of this agreement, that the annual rate and monthly installments in effect at the time the agreement is accepted by the TTC will not be increased during the initial 12-month period. If the customer does not wish the Metropass Discount Plan to be renewed then he/she shall so advise the TTC in writing at least 15 days prior to the next renewal date and, in such event, the Metropass Discount Plan agreement shall terminate on the last day of the month preceding the renewal date.
- The TTC is authorized to change the amount of the annualized fee at any time after the anniversary thereof and accordingly the monthly installments. The customer must advise the TTC in writing that he/she does not accept the increased fee, within 15 days of the TTC announcing a fare increase. If the customer advises the TTC in writing that he/she does not accept the change then the customer’s fee shall not be changed and this agreement shall be terminated on the last day of the month preceding the renewal date.
- This agreement is for a minimum of 12 months. Should the customer cancel the agreement prior to the expiration of the initial 12-month period, or during any renewal period thereof, the customer agrees that the TTC will deduct from the customer’s account, as indicated on the application, or any amended account given to the TTC by way of written notice from the customer pursuant to the agreement, the difference between the regular price of a monthly TTC Metropass and the reduced monthly installments billed to the customer under this Metropass Discount Plan agreement multiplied by the number of months already passed during the original 12-month period or any renewal thereof and will not exceed 11 months. No portion of any month’s Metropass shall be refunded to the customer. In the event of cancellation a full month’s installment shall be refunded to the customer should he/she return the monthly Metropass to the TTC prior to the first day of the month to be covered by said monthly Metropass Discount Plan.
- The customer shall receive the monthly portions of the Metropass Discount Plan by regular mail at the address designated on the application or at any subsequent address as the customer may advise the TTC in writing. Receipt of the monthly portions of the Metropass Discount Plan shall be deemed to be made 3 days after mailing by the TTC. In the event of a postal interruption during which we are unable to deliver your Metropass by courier, you may be required to pick it up at a location designated by the TTC.
- Personal information is collected under the authority of the City of Toronto Act, 2006, S.O. 2006, c. 11, Schedule A, including but not limited to sections 394 to 398, and the Municipal Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. M.56. All information collected regarding this agreement, whether provided by the customer or third parties will, except for the conditions contained in clause 13, be for the purpose of implementing and administering the Metropass Discount Plan. The customer hereby consents to the TTC conducting any credit checks and other financial verification directly or indirectly without further notice to the customer, as it deems fit.
- The customer consents to the use and disclosure to third parties by the TTC of information relating to his or her name, phone number, address, and TTC Metropass serial number for the purposes of verification that the customer is a Metropass Discount Plan holder and for the purpose of the customer being provided with third party value added product information and for the purpose of research for the product evaluation and improvements.
- The customer has certain recourse rights if any debit does not comply with this agreement. For example, the customer has the right to receive reimbursement for any debit that is not authorized or is not consistent with this Pre-Authorized Debits (PAD’s) Agreement. To obtain more information on recourse rights, the customer may contact his/her financial institution or visit www.cdnpay.ca.

The TTC agrees not to disclose any financial information contained herein to third parties without the written consent of the customer.
